Samuel Adams: The “Father of the American Revolution”

Born Sept. 27, 1722 - some “experts” would have you believe his political career “peaked” in 1776, and mostly ended there. But more important were his ideas, which not only helped influence an entire generation to resist the empire, but can live on today as well - and help drive resistance to another.

Another Unconstitutional War: This Time in Congo

Instead of a declaration of war, Biden, along with Bush, Obama, and Trump before him, relies on the authorization to use military force (AUMF) passed by Congress in the wake of 9/11 to justify military action across the globe. But this stretches the president’s constitutional authority far beyond the breaking point.

OSHA Is Not Regulating “Commerce”

I have asserted that OSHA is an unconstitutional federal agency. I've gotten some pushback from folks who say it is authorized by the "commerce clause." But this is a complete misunderstanding of the meaning of the word "commerce" in the Constitution.

Originalism and Citizens United (Again)

To be clear, the issue in Citizens United was whether corporations (and labor unions and non-profit associations like the ACLU) could spend money to express their opinions about candidates.  I think there most certainly is a "plausible argument" that the original meaning of the First Amendment included such a right.
