Colorado Committee Holds Hearing on Bill to End Civil Asset Forfeiture and Further Opt State Out of Federal Program

a Colorado House committee held a hearing on a bill that would end civil asset forfeiture in the state and replace it with a criminal process. The enactment of this legislation would also further opt the state out of a program that allows police to circumvent more strict state forfeiture laws by passing cases off to the feds.

Colorado Bill Would End Civil Asset Forfeiture and Further Opt State Out of Federal Program

HB1086 builds on previous forfeiture reforms. In 2017, Colorado imposed strict reporting requirements on asset forfeiture in the state and it expanded those requirements in 2018. This kind of transparency often creates the momentum needed to drive future change.

Colorado Bill Would Take on Federal Gun Control; Past, Present, and Future

Titled the “Second Amendment Preservation Act,” (SAPA) the legislation would ban any entity or person, including any public officer or employee of the state and its political subdivisions, from enforcing any past, present or future federal “acts, laws, executive orders, administrative orders, court orders, rules, regulations, statutes, or ordinances” that infringe on the right to keep and bear arms.

Signed as Law: Colorado Limits Government Use of Facial Recognition

The law prohibits Colorado law enforcement agencies from engaging in ongoing surveillance, conducting real-time or near real-time identification, or from starting persistent tracking using facial recognition without a warrant in most situations. In order to obtain a warrant, police must first establish probable cause and show that the use of facial recognition is necessary to develop leads in an investigation.
