Federal Law is not “Always Supreme”

Even though most people seem to believe it – and the government definitely acts as if it were true, federal law is not “always supreme” – all the time. Arguing in support of that requires ignoring the words of the supremacy clause – and the history of the American Revolution, which was a rejection of this kind of unlimited, centralized power.

Maryland House Passes Bill to Limit Law Enforcement Use of Facial Recognition

To the Governor: Idaho Passes Bill to Expand Raw Milk Sales in the State

In effect, the changes in the law would facilitate herd shares and make it easier for people willing to pay another individual for the upkeep of milk-producing livestock to share raw milk and other things produced from the raw milk of those shared animals.

New Hampshire House Passes Bill to Legalize Marijuana With No Taxation or Regulation

The legislation would remove marijuana from the state’s list of banned substances and strike provisions in current law that refer to criminal penalties for cannabis-related offenses. The proposed law would not create any kind of tax or regulatory program for marijuana. It would effectively become legal to possess, cultivate, buy, and sell cannabis just like tomatoes.

Maine Bill Would Set Foundation to End Unconstitutional National Guard Deployments

Titled the Defend the Guard Act, under the proposed law, the Maine governor could not release the state’s National Guard units into “active duty combat” unless Congress has “passed an official declaration of war or taken official action pursuant to Article 1, Section 8, Clause 15 of the United States Constitution.”
