South Carolina Bills Would End Civil Asset Forfeiture, Opt State Out of Federal Program in Most Cases

Under current South Carolina forfeiture procedures, the state can take a person’s property without even charging them with a crime. The Institute for Justice gave South Carolina a D- grade for its current forfeiture laws, saying, “South Carolina’s civil forfeiture laws offer very little protection for property owners.”

The Bank-Run Phenomenon

The idea is that people don’t have to worry about losing their money if their bank goes under because the federal government will use taxpayer money to reimburse them. Thus, knowing that their money is “insured” by the government, people have less incentive to rush to the bank to withdraw their money in the event of a potential bank failure.

Texas Bill Would Create Foundation to End Unconstitutional National Guard Deployments

The legislation would prohibit the governor from releasing any unit or member of the Texas National Guard into “active duty combat” unless “Congress officially declares war in accordance with Clause 11, Section 8, Article I, United States Constitution, or takes other official action in accordance with Clause 15, Section 8, Article I, United States Constitution.”

Today in History: Preparations Begin for Impeachment Trial of Justice Samuel Chase

A signer of the Declaration of Independence, Chase had been impeached by the House of Representatives for his role in the Sedition Act Crisis of 1798-1799. In 1798, Congress passed an act that made it a criminal offense to criticize the President of the United States and members of Congress.

Texas Bill Would Ban “No-Knock” Warrants

The legislation would ban Texas judges from issuing warrants allowing “no-knock” entry. The bill defines “no-knock entry” as “a peace officer’s entry, for the purpose of executing a warrant, into a building or other place without giving notice of the officer’s authority or purpose before entering.”
