Using Language to Expand Power

In 1984, George Orwell portrayed in chilling detail how totalitarian governments use the power of language to manipulate the masses. This notion was not unfamiliar to the founders, as James Madison warned that changing definitions of words over time would create “a metamorphosis” that would destroy the original limitations of the Constitution.

Most of the Federal Administrative State is Unconstitutional

Supporters of the monster state justify most federal power under a twisted version of the commerce clause - claiming the power “to regulate Commerce ... among the several States” gives them power over pretty much anything and everything. But they’re lying.

Protect and Serve Act: Another Bipartisan Attack on the Tenth Amendment from Congress

Using a dangerously expansive view of the “interstate commerce clause,” they created a new federal crime. If passed,…

Federal Regulation of Electric Power and the Commerce Clause

While the federal government has some authority to regulate electricity flowing across state lines under the commerce clause, the federal government has seized much more power than it was legitimately delegated. As I reported earlier, on Sept. 28, 2017, Secretary of Energy Rick Perry proposed a new rulemaking to the Federal Energy Regulatory Commission (FERC).…

Federal Proposal to Regulate Electric Power Rates Largely Unconstitutional

A proposal to expand federal regulation of electric power rates is largely unconstitutional. On Sept. 28, 2017, the U.S. Secretary of Energy Ernest Moniz proposed new rulemaking to the Federal Energy Regulatory Commission (FERC). Under the authority granted the secretary under the Department of Energy Organization Act, RM18-1-000, he proposes that the FERC should use…
