World’s largest pot shop can stay open in Oakland, judge rules

"A medical marijuana dispensary billed as the world’s largest cannabis store may stay open while the city of Oakland fights a U.S. government effort to shut it down or seize the property, a federal judge ruled on Wednesday. There has been a tug-of-war in California between federal and local authorities over cannabis sold for purported health reasons. In February, Magistrate Maria-Elena James, the same judge who ruled on Wednesday, said the city had no right to intervene in a federal prosecutor’s civil-forfeiture action against the Harborside Health Center, which was featured on the Discovery Channel reality TV show 'Weed Wars.'" Pot Is Legal, but Some Towns Won’t Partake

"More than two dozen cities and towns have already prohibited marijuana retail stores, according to the Colorado Municipal League, a lobbying group for the state's cities. Others, like Aurora outside of Denver, decided to postpone a decision on whether to allow sales. In Denver, leaders want to allow pot sales, but have said they want to push back the starting date for new businesses other than medical-pot outlets. The opt-out clause included in the Colorado pot law doesn't exist in Washington, which also legalized recreational pot last November. Vermont Marijuana Decriminalization Law Goes Into Effect

"Starting Monday, Vermonters will not be arrested for possessing less than an ounce of marijuana. The decriminalization law, signed by Vermont Gov. Peter Shumlin (D) last month, will remove criminal penalties on small amounts of cannabis and replace them with civil fines. According to the new measure, first-time offenders will not get more than a $200 fine for possession. The fine will increase for repeat offenders -- $300 for a second offense and $500 for every offense thereafter -- but, under the law, marijuana possession will no longer result in the creation of a criminal record." "The legislation triggered fierce opposition by municipalities, which feared competition. Those objections were answered in floor debate by the observation that municipalities could themselves convert to ZEDE, winning all the same advantages. On June 12, 2013, the ZEDE legislation passed by a vote of 102 to 26. Meanwhile, on June 14, Governor Perry signed into another important bill. As explained prior to Governor Perry’s signing of the bill by the blog Law360, HB 2268 'would establish the strongest email privacy protections in the U.S. by becoming the first measure to override a provision in the federal Electronic Communications Privacy Act that allows law enforcement to access emails that are open or more than 180 days old using only a subpoena.'" U.S. Conference of Mayors asks Obama for flexibility on marijuana

"The United States Conference of Mayors unanimously passed a historic, bipartisan resolution calling on the Obama administration to stop interfering with state and local efforts to deal with the problems caused by marijuana prohibition. 'This resolution will amplify the voices of local officials and voters who are sick and tired of President Obama’s administration doing the exact opposite of what candidate Obama said he was going to do, which was respect state marijuana laws,' a spokesperson for drug reform advocacy group Marijuana Majority said.
