Marijuana’s IRS Problems Spark New Bill

"Rep. Earl Blumenauer (D-OR) will introduce the Small Business Tax Equity Act of 2013 on June 5, with the goal of ending the Internal Revenue Service’s persecution of medical cannabis dispensaries. The Small Business Tax Equity Act of 2013 will amend IRS Section 280E of the tax code to resolve a crisis in the newly legal billion-dollar industry, according to Betty Aldworth with the Washington D.C. lobby National Cannabis Industry Association. Marijuana is a federally illegal drug that 20 states have legalized for medical purposes. Two have legalized its use for adults over 21. But the IRS treats all marijuana-related businesses as 'drug trafficking organizations'." Continue reading

Facing 81 Years For Marijuana, Rich Paul Planning To Appeal Convictions

"Rich Paul, political activist and founder of the 420 Foundation, is seeking help to appeal the guilty verdict he received recently at Cheshire Superior Court in Keene, NH. Rich was on trial for selling marijuana to an undercover Drug Task Force informant. The drug sting was led by the Federal Bureau of Investigation and culminated with Rich Paul being asked to 'cooperate' with the FBI in order to ensnare more local activists by wearing a wire into the Keene Activist Center. The appeal will center around the recent New Hampshire State Law, HB 146, which affirms the legality of a jury to judge not just the case but the law itself." Continue reading

San Diego Mayor Bob Filner Urges ‘Jury Nullification’ In Medical Pot Dispensary Case

"San Diego Mayor Bob Filner has injected himself into a federal criminal case against the operator of a medical marijuana dispensary, intensifying his standoff with federal prosecutors on cannabis enforcement issues. Filner's urging jurors who'll be chosen for the trial to reject federal law in favor of state statutes under a centuries-old legal concept known as 'jury nullification'-- whereby jurors can refuse to convict people under laws they believe should not be applied." Colorado Gun Control Law Is Unenforceable, Say 54 Of 62 Colorado Sheriffs

"A gun control law set to go into effect in July specifies that anytime that a gun owner allows anyone to have control of his gun for over 72 hours, that person to receive the gun must go through a background check. Of Colorado’s 62 sheriffs, 54 are publicly protesting the law. It is unenforceable, they say. The law has other unenforceable features, such as banning rifle magazines that could possibly be expanded to hold more than 15 rounds. Anyone who owns such a magazine cannot sell it or lend it. The sheriffs are part of a lawsuit in federal court. The lawsuit says the law is unconstitutional. The state committee that heard testimony allowed only one sheriff to testify." Continue reading

Erie County Sheriff Howard on SAFE Act: ‘I won’t enforce it’

"It’s no secret Sheriff Timothy B. Howard is opposed to New York’s new gun-control law. But Howard, who is running for re-election this year, is now ratcheting up his opposition by filing a friend of the court brief in the lawsuit seeking to overturn the SAFE Act and, even more important perhaps, by suggesting the law not be enforced. 'I’m more than reluctant,' he said of the new law Thursday. 'I won’t enforce it.' Howard, one of four sheriffs who joined in filing the brief this week, said he considers the law unconstitutional and a waste of valuable resources, and believes it will ultimately be overturned by the courts." First major hemp crop in 60 years is planted in southeast Colorado

"Springfield, Colo., farmer Ryan Loflin on Monday planted the nation's first industrial hemp crop in almost 60 years. Loflin's plans to grow hemp already have been chronicled, and Monday's planting attracted the attention of more media in southeastern Colorado and a documentary film crew. Its cultivation in small test plots became legal last year under a Colorado law. The passage of Amendment 64 in November allowed commercial growing, even though hemp, like marijuana, is illegal under federal law." Continue reading

Rasmussen Poll: Nullification Goes Mainstream

"Day after day, the media pounds out a relentless drumbeat against nullification. Pundits, commentators and so-called legal experts demonize it as unconstitutional, villainize it as racist and trivialize it with slurs like 'wacky' and 'kookie.' But while the political class continues to arrogantly ridicule Madison and Jefferson’s principles, everyday Americans embrace them in increasing numbers. A Rasmussen poll released Monday indicates that nullification is growing more and more popular in mainstream America. More people than not approve of nullification in general." Continue reading

Colorado passes laws for the legal sale of marijuana beginning Jan. 1

Texas House approves bundle of radical pro-gun laws

"The bills that passed include a measure letting college students over 21-years-old carry weapons in classrooms. Lawmakers also approved letting schools select employees to carry concealed weapons on campus, and easing the standards for concealed carry permits. The bulk of the bills were targeted at easing restrictions on concealed carry weapons, such as making permit fees cheaper, preventing agencies from asking for detailed information on permit renewals, and restricting fingerprint registries for gun owners. The package of bills also includes a measure that declares all federal gun laws null and void in Texas." Continue reading
