A handful of states have put a stop - at least for now - to the next phase of gun control: Tracking, monitoring and keeping lists based off of Merchant Category Codes (MCC), which were first mandated by the IRS in 2004.

Signed by the Governor: West Virginia Prohibits Using Credit Card Information to Track Firearms Purchases Without a Warrant

The new law prohibits any West Virginia governmental entity from accessing or obtaining a record of a transaction involving a credit card that is retrieved, characterized, generated, labeled, sorted, or grouped based on the assignment of a firearms code without a warrant or a subpoena in most situations

Montana Committee Passes Bill to Amend State Constitution on Concealed Carry

HB551 would place an amendment on the ballot to remove “but nothing herein contained shall be held to permit the carrying of concealed weapons” from that section.

To the Governor: Mississippi Bill to Prohibit Credit Card Tracking Codes on Firearms Purchases

Titled the Second Amendment Financial Privacy Act, the legislation would prohibit a financial institution or its agent from requiring the usage of a firearms code in a way that distinguishes a firearms retailer physically located in the state of Mississippi from general merchandise retailers or sporting goods retailers.

Kentucky Law Bans Enforcement of Some Federal Gun Control, Including Pistol Brace Rule

The law prohibits Kentucky law enforcement agencies, local governments, and public agencies from adopting a rule, order, ordinance, or policy under which the entity enforces, assists in the enforcement of, or otherwise cooperates in a “federal ban” on firearms, ammunition, or firearm accessory. It also prohibits the expenditure of public funds for the same.

Alabama Second Amendment Financial Privacy Act Takes Steps Against Merchant Code Surveillance

Concern about the misuse of firearms databases isn’t just paranoia. The Taliban has reportedly used a firearm ownership database created by the U.S. government to track down gun owners and confiscate firearms in Afghanistan. This goes to show that even if you trust the people creating the database, it can fall into the wrong hands. In other words, the very existence of a database is a danger.

Florida Senate Passes Bill to Prohibit Using Credit Card Information to Track Firearms Purchases

The 2nd Amendment Financial Privacy Act would prohibit a payment settlement entity, merchant acquiring entity, or a third-party settlement organization from assigning a merchant category code or otherwise classifying a merchant that is a seller of firearms or ammunition separately from general merchandise retailers or sporting goods retailers.
