Signed by the Governor: Montana Law Expands Right to Try Act

Gov. Greg Gianforte signed a bill into law that significantly expands the state’s  current “Right to Try” law, setting the foundation to nullify in practice additional Food and Drug Administration (FDA) rules that deny access to experimental treatments to patients in Montana.

Texas House Passes Bill to Ban State Enforcement of Some Federal Rules and Regulations on Oil and Gas Production

The proposed law would prohibit any state agency or its employees from contracting with or providing assistance "to a federal agency or official with respect to the enforcement of a federal statute, order, rule, or regulation purporting to regulate oil and gas operations" if it does not exist under the laws of Texas.

Signed by the Governor: Maryland Law Regulating Adult-Use Marijuana Despite Ongoing Federal Cannabis Prohibition

In November 2022, Maryland voters passed Question 4, legalizing the use of cannabis by an individual who is 21 or older. The amendment also authorizes the Maryland General Assembly to “provide for the use, distribution, possession, regulation, and taxation of cannabis within the state.”

Pennsylvania Bill Would Ban State and Local Enforcement of Some Federal Gun Control

The legislation declares that a "federal action" relating to a firearm, magazine of a firearm, accessory, and ammunition, intended to restrict possession, transfer, or use of the same "shall be unenforcible" by an official, agent, or employee of Pennsylvania or a political subdivision of the state.
