Under the proposed law, “entities,” including Kentucky law enforcement agencies, local government agencies, schools, HOAs, and private companies legally using ALPRs “for the sole purpose of protecting public safety, conducting criminal investigations, or ensuring compliance with local, state, or federal laws” could only retain collected data for 90 days.

The bill would make numerous changes to the Kentucky state tax code. Provisions in the bill would exempt the sale of gold, silver, platinum and palladium bullion, including bars, ingots and coins from the state sales tax.

Titled the Defend the Guard Act, under the proposed law, the Kentucky governor could not release the state’s National Guard units into “active duty combat” unless the federal government has satisfied any outstanding balance to the Kentucky National Guard and Congress has “passed an official declaration of war or taken official action pursuant to Article 1, Section 8, Clause 15 of the United States Constitution to explicitly call forth the Kentucky National Guard and any member of the Guard for enumerated purposes to expressly execute the laws of the Commonwealth, repel invasion, or suppress insurrections.”

The legislation is similar to a law passed by Montana in 2021 and already taking effect against two ATF regulations from executive orders issued by Joe Biden – including the most recent pistol brace rule.
