Under the final version of the bill passed in both the House and Senate, adults 21 and over could legally possess up to 2 ounces of marijuana in public. They would also be able to have up to 2 pounds of processed marijuana in their homes and grow up to 8 cannabis plants (4 mature).

Maine Bill Would Allow CBD in Food Despite FDA Prohibition

The legislation would recognize cannabis and hemp as food as a protected right under the Constitution in Maine. In effect, this would ensure there is no state ban on the sale of food, drinks, or supplements containing cannabinoids or THC. This is crucial because the federal government continues to prohibit cannabis as a controlled substance, and despite removing hemp from the list of controlled substances, the federal government still prohibits the sale of CBD products in food under FDA rules.
